A breach or violation of these Terms may result in cancellation of your order, refusal of service, or termination of your access to our website.

We reserve the right to refuse service to anyone for any reason at any time, including but not limited to orders that contain offensive, unlawful, abusive, threatening, hateful, sexually explicit, infringing, or inappropriate content.

You understand that content you submit to us, including names, dates, photos, text, designs, messages, logos, event details, or other personalization information, may be transferred over various networks and may be adjusted to meet technical, production, printing, formatting, or design requirements. Payment information is handled through secure payment processors and is not stored by Photo Fun Zone.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, or misuse any portion of our website, product designs, templates, product photos, written content, QR systems, layouts, mockups, or any other materials without our written permission.

The headings used in these Terms are included for convenience only and do not limit or otherwise affect these Terms.

Section 4 — Custom and Personalized Products

Many of our products are custom, personalized, made-to-order, or created specifically for your event. You are responsible for providing accurate information at the time of purchase, including but not limited to:

You are responsible for reviewing all order details before submitting your order. If we provide a proof or preview, you are responsible for reviewing it carefully before approval. This includes checking spelling, grammar, names, dates, colors, layout, photo choice, QR code destination, and all other details.

Once a proof is approved, or once production has started, changes may not be possible. If you approve a proof that contains an error, or if you submit incorrect information, Photo Fun Zone is not responsible for replacing, refunding, or reprinting the order unless we choose to do so at our sole discretion.

Because custom and personalized products are made specifically for each customer, they may not be eligible for cancellation, return, refund, or exchange once production has started, unless the product arrives damaged, defective, or materially different from what was ordered due to an error by Photo Fun Zone.

Section 5 — Customer-Provided Photos, Logos, Text, and Content

By submitting photos, names, logos, artwork, phrases, text, videos, audio, QR links, or other content to Photo Fun Zone, you represent and warrant that:

You own the content or have the legal right and permission to use it.
The content does not violate any copyright, trademark, privacy right, publicity right, or other right of any person or business.
The content is not unlawful, harmful, threatening, abusive, defamatory, obscene, hateful, discriminatory, or otherwise inappropriate.
You have permission from any individuals shown in submitted photos or videos, including permission to use their image or likeness for the product you ordered.

You grant Photo Fun Zone a limited right to use the submitted content solely for the purpose of designing, producing, fulfilling, and delivering your order, communicating with you about your order, and providing related customer support.

We reserve the right to refuse, cancel, or modify any order that contains content we believe may be unlawful, infringing, offensive, inappropriate, or unsuitable for production.

Photo Fun Zone is not responsible for claims, disputes, damages, or legal issues arising from customer-provided content. You agree to indemnify and hold Photo Fun Zone harmless from any claims related to content you submit.

Section 6 — Product Colors, Images, Sizes, and Materials

We make every effort to display product images, colors, sizes, materials, and descriptions as accurately as possible. However, we cannot guarantee that your computer, phone, or device screen will display colors accurately.

Printed colors may vary slightly from digital previews due to screen settings, printer calibration, material differences, lighting, coating, and production methods.

Product sizes are approximate and may vary slightly due to trimming, printing, manufacturing, or material tolerances. Small variations in color, size, placement, alignment, finish, or texture are not considered defects unless the product is materially different from the description.

Section 7 — QR Codes, Video Messages, Audio Messages, and Digital Features

Some Photo Fun Zone products may include QR codes, video message features, audio message features, online recording pages, or digital collection tools. These features may rely on third-party platforms, web hosting, internet access, mobile devices, cameras, microphones, browser permissions, or other technology outside of our direct control.

You understand and agree that:

QR codes must be tested by the customer before the event.
Customers are responsible for making sure guests have internet access and compatible devices.
Third-party platforms may change, update, experience downtime, limit usage, or discontinue features.
Photo Fun Zone is not responsible for a guest’s inability to scan a QR code, record a message, upload a message, use a device, access the internet, or complete a submission due to technical issues outside of our control.
We are not responsible for lost, deleted, incomplete, poor-quality, or failed video/audio submissions unless caused directly by our own error.
Any delivery of collected digital messages, files, or links will be handled according to the product description, order details, or separate communication provided by Photo Fun Zone.

If your product includes a QR code, you are responsible for confirming that the QR code destination is correct before using the product at your event.

Section 8 — Order Acceptance, Refusal, and Cancellation

We reserve the right to refuse or cancel any order you place with us. We may limit or cancel quantities purchased per person, per household, per event, per business, or per order.

We may cancel or refuse orders that appear to be fraudulent, abusive, incomplete, suspicious, incorrectly priced, placed by unauthorized resellers, or otherwise in violation of these Terms.

If we make a change to or cancel an order, we may attempt to notify you using the email address, billing address, shipping address, or phone number provided at the time the order was placed.

Order cancellation requests must be submitted as soon as possible by contacting us at info@photofunzone.com. Cancellation is not guaranteed. If production has already started, the order may no longer be cancelable.

Section 9 — Pricing, Promotions, and Product Availability

Prices for our products are subject to change without notice.

We reserve the right to modify, discontinue, update, or limit any product, product option, design, promotion, discount, bundle, or offer at any time without notice.

Promotions, discount codes, and special offers may be limited by date, product type, quantity, customer, location, or other conditions. We reserve the right to cancel or refuse any promotion or discount if it is misused, expired, applied incorrectly, or used in a way that violates the terms of the offer.

We are not liable to you or any third party for any price change, product modification, product discontinuation, website update, promotion change, or product unavailability.

Section 10 — Billing and Account Information

You agree to provide current, complete, and accurate purchase, billing, shipping, and account information for all purchases made through our store.

You agree to promptly update your information, including email address, shipping address, billing address, and payment information, so we can complete your order and contact you as needed.

Photo Fun Zone is not responsible for delays, failed deliveries, incorrect shipments, or lost orders caused by inaccurate or incomplete customer information.

Section 11 — Production Times, Shipping, and Delivery

Production times, processing times, shipping times, and delivery estimates are estimates only and are not guaranteed unless expressly stated in writing.

You are responsible for ordering early enough to receive your products before your event date. Photo Fun Zone is not responsible for missed event deadlines due to customer delay, late approvals, incorrect shipping information, carrier delays, weather, holidays, customs delays, failed delivery attempts, or other circumstances outside of our control.

Shipping carriers are third-party companies. Once an order is shipped, delivery timing and handling are controlled by the carrier. We are not responsible for carrier delays, lost packages, stolen packages, damaged packages, incorrect delivery scans, or packages marked delivered but not received. However, we may assist with filing claims or resolving shipping concerns when possible.

If your package arrives damaged, you must contact us as soon as possible at info@photofunzone.com and provide photos of the damaged product, packaging, shipping label, and any other requested information.

Section 12 — Returns, Refunds, and Exchanges

Because many Photo Fun Zone products are custom, personalized, or made to order, returns, refunds, and exchanges may be limited.

Custom or personalized items are generally not eligible for return, refund, or exchange unless they arrive damaged, defective, or materially different from what was ordered due to an error by Photo Fun Zone.

Non-custom products, if any, may be eligible for return or exchange only according to our posted Return Policy.

Refunds are not guaranteed for customer errors, including but not limited to:

Misspelled names
Incorrect dates
Wrong event details
Low-quality uploaded photos
Incorrect shipping addresses
Late ordering
Failure to review or approve a proof
Approval of a proof containing an error
Change of mind
Event cancellation
Color differences caused by screen display variations
Minor print, trim, or material variations

Section 13 — Product Safety and Proper Use

You agree to use all Photo Fun Zone products safely and responsibly.

Some products may include magnets, printed materials, display stands, small parts, sharp edges, adhesives, clips, or other components that should be kept away from young children unless supervised by an adult.

Magnets can be dangerous if swallowed and may interfere with medical devices, electronics, credit cards, or other magnetic-sensitive items. Keep magnets away from small children, pets, pacemakers, medical implants, and sensitive electronics.

Photo booth props, signs, table displays, and event products are intended for decorative, keepsake, or event-use purposes only. They should not be used as toys, protective equipment, food-contact surfaces, or for any unsafe purpose.

Photo Fun Zone is not responsible for injuries, damage, misuse, or accidents resulting from improper handling, unsafe use, lack of supervision, or use of products in a manner not intended.

Section 14 — Optional Tools and Third-Party Services

We may provide access to third-party tools, platforms, apps, payment processors, shipping carriers, QR code services, recording tools, video hosting tools, or other services that we do not own or control.

You acknowledge and agree that third-party tools are provided “as is” and “as available” without warranties, representations, or conditions of any kind from Photo Fun Zone.

Any use of third-party tools is at your own risk and subject to the terms, policies, and practices of the third-party provider.

We are not responsible for any issue, loss, damage, error, outage, update, limitation, or discontinued service caused by a third-party provider.

Unless otherwise stated in writing, custom product purchases include the finished physical product only and do not include editable design files, source files, layered files, templates, or commercial reproduction rights.

Section 21 — Disclaimer of Warranties and Limitation of Liability

We do not guarantee, represent, or warrant that your use of our website, store, products, digital features, QR codes, video message tools, or third-party services will be uninterrupted, timely, secure, error-free, or available at all times.

Because some states or jurisdictions do not allow the exclusion or limitation of certain damages, our liability in those states or jurisdictions shall be limited to the maximum extent permitted by law.
